EB5 Statistics Highlight Upward Trend

USCIS recently released data for fiscal Q4 2023, covering July 1st to September 30th, providing insights into the EB-5 program's performance and trends. Key highlights include:

Investor form I526:

  • In Q4, 954 new investors submitted I526 forms, with 888 opting for the Regional Center program and 57 pursuing individual business ventures.

  • The total number of EB-5 applicants in 2023 reached 2,735, marking a significant three-fold increase compared to 2021 and 2022.

  • The denial rate decreased from 58.3% in 2022 to 39.5% in 2023, though still relatively high.

  • USCIS processing capacity for I-526 petitions doubled in 2023, reviewing 3,626 applications, but there are still 12,140 pending petitions.

Investor form I-829:

  • The number of new I-829 petitions remained stable at 1,157 applications, with a slight increase in the denial rate from 10.36% in 2022 to 12.76% in 2023.

Regional Center forms:

  • 25 new Regional Centers submitted I956 applications in 2023, taking an average of nine months for approvals.

  • Q4 witnessed the launch of 46 new EB-5 projects, contributing to a total of 231 projects post the Reform and Integrity Act (RIA), with 185 initiated in 2023. The average processing time for I956F approval was 12.8 months
